EnKrist — Terms of Service


1. Agreement to these Terms

These Terms of Service ("Terms") are a binding agreement between you and EnKrist LLC, a for-profit company ("EnKrist," "we," "us"), governing your access to and use of the EnKrist platform (the "Service").

By registering for or using the Service, you agree to these Terms, to our [Privacy Policy] (how we handle your data), and to our Acceptable Use Policy ("AUP," conduct and content) — each incorporated by reference. If you do not agree, do not use the Service.

The Service is access-restricted (registration requires a valid access code) and strictly for adults (18+). See §3.

2. Stage of the Service — MVP / closed pilot, provided "as is"

EnKrist is at an early, invitation-restricted pilot stage. The Service is provided for evaluation and community use as it exists today and is under active development: features may change, be added, or be removed, and the Service may be interrupted. These Terms govern only the current Service — an adults-only, access-code-gated community with text-and-image content, private one-to-one and group messaging, and member-created communities.

Capabilities not part of the current Service — including family/guardian-constituted circles involving minors, audio and video, removal of the access-code wall (public access), payments, subscriptions, or advertising, and institutional verification — are not offered under these Terms and, if introduced, will be governed by separate terms that we will review and, where required, ask you to agree to before they launch (§17).

3. Eligibility

To use the Service, you must:

  • be at least 18 years old;
  • hold a valid access code issued by or on behalf of EnKrist;
  • provide accurate registration information and keep it current;
  • have the legal capacity to enter into these Terms; and
  • not be barred from using the Service under applicable law or by a prior EnKrist enforcement action (e.g., a ban).

By registering you affirm that you are 18 or older. EnKrist is not built for, and does not knowingly admit, minors. The community types that would gather minors (family, school, and ministry-to-minors) cannot be created on the Service — this is enforced structurally, not merely promised (§8, and the Privacy Policy §8).

4. Your account

You are responsible for your account and for keeping your login credentials secure. You must notify us promptly of any unauthorized use. We manage authentication through a third-party provider and never store your password in readable form. We may verify your eligibility and may refuse, suspend, or terminate registration that violates these Terms.

5. The Service and how content reaches others

EnKrist lets you join and create communities, author content (reflections, prayers, witness posts, comments), send private one-to-one and group messages, and engage with others' content. You control the audience of what you post by choosing an audience scope (e.g., private; a specific community or communities; or "everyone within the platform"). During the current walled pilot, content addressed to "everyone" is visible only to admitted members of the platform — it is not published to the open internet. Private messages are visible only to their participants.

6. Acceptable use

Your use of the Service is subject to the AUP, which is incorporated into these Terms. Among other things, you must not use the Service to post unlawful, harmful, harassing, hateful, or obscene content, to impersonate others, or to harm or exploit any person. Child sexual abuse material (CSAM) and any sexualization of minors are absolutely prohibited and will be handled through lawful channels. We may act on violations as set out in §9.

7. Your content and the license you grant us

You own your content. These Terms do not transfer ownership of anything you create.

To operate the Service, you grant EnKrist a limited, non-exclusive, worldwide, royalty-free license to host, store, back up, reproduce, transmit, and display your content — solely to the audiences you have selected and solely to provide, secure, and maintain the Service. This license exists only for the purpose of running the Service; it ends when you delete the content or your account, except for (i) copies retained in routine backups for a limited period and (ii) records we are legally required or permitted to retain (see the Privacy Policy §7).

This license is not a license to use, publish, or commercialize your content beyond providing the Service to your selected audiences. We will not use your content for advertising, promotion, or any monetization without your separate, specific consent under terms presented at that time.

You represent that you have the rights necessary to post your content and to grant this license, and that your content does not infringe others' rights or violate the AUP or law.

8. Communities, owners, and moderation

Members may create open-type communities and, on creation, become that community's owner-administrator, with the ability to manage its membership and content within EnKrist's rules. Owners may delegate moderation. Membership, roles, and removal operate as provided in the Service.

Owner responsibility and EnKrist's floor. A community owner is responsible for what they and their members place in their community space — except where content or conduct violates EnKrist's platform floor or the law, at which point EnKrist intervenes as the floor-enforcer. EnKrist provides "the rails and the global floor" (lawful, ethical, non-obscene); it does not otherwise control an owner's good-faith editorial choices within their space.

Structural limits. Certain community types (family, school, ministry-to-minors) cannot be created on the Service (child-safety containment, §3).

9. Reporting, moderation, and enforcement

We provide a way to report content and conduct, including a first-class child-safety report category that is routed to elevated review. We are not obligated to monitor all content, but we reserve the right to review reported (and, where necessary, other) content and to take action — including removing content, limiting features, and suspending or terminating accounts or communities — where we reasonably believe these Terms, the AUP, or the law have been violated, or to protect the safety of a person or the public.

Reports that surface potentially-illegal material, including CSAM, are handled through our internal procedures and lawful channels. We may preserve and disclose information where legally required or necessary to protect safety.

Our handling of your personal data is described in the [Privacy Policy]. Because the Service is a faith-community platform, using it involves EnKrist processing special-category data revealing your religious beliefs; you provide explicit consent to that processing at sign-up, and you may withdraw it as described in the Privacy Policy (§3, §9). You retain data-subject rights (access, export, erasure, and others) as set out there.

11. Our intellectual property

EnKrist, its name and marks, the platform software, design, and content we create are owned by EnKrist or our licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose while these Terms are in effect. You must not copy, modify, reverse-engineer, scrape, resell, or create derivative works of the Service, or use our marks, except as expressly permitted or required by law.

12. Third-party services

The Service relies on third-party providers (for example, hosting, authentication, email delivery, and analytics — see the Privacy Policy §10). We are not responsible for third-party services' availability or acts, and your use may be subject to their terms where applicable.

13. Disclaimers

[TO BE FINALISED BY COUNSEL — regime-appropriate wording.] The Service is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. As an early pilot, the Service may contain errors, be interrupted, or change. Content on the Service is created by members and does not represent the views of EnKrist; we do not endorse and are not responsible for members' content.

14. Limitation of liability

[TO BE FINALISED BY COUNSEL — cap and carve-outs depend on jurisdiction.] To the fullest extent permitted by law, EnKrist will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim will not exceed [CAP — e.g., amounts you paid us in the prior 12 months, or a fixed sum for a free pilot]. Nothing in these Terms excludes liability that cannot lawfully be excluded (e.g., for death or personal injury caused by negligence, or fraud).

15. Indemnification

[COUNSEL TO CONFIRM SCOPE.] You agree to indemnify and hold EnKrist harmless from claims and losses arising out of your content, your use of the Service, or your breach of these Terms, the AUP, or the law, to the extent permitted by applicable law.

16. Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access — with or without notice where appropriate — if you violate these Terms, the AUP, or the law, or where necessary to protect the Service or others. On termination, your license to use the Service ends; the handling and deletion of your data is governed by the [Privacy Policy §7]. Sections that by their nature should survive (including §7 representations, §11, §13–§15, §18) survive termination.

17. Changes to the Service and to these Terms

We may modify the Service and these Terms. If we make a material change to these Terms, we will notify you and, consistent with how the platform versions agreements, ask you to review and agree before continued use where required. Your continued use after a change takes effect constitutes acceptance of the updated Terms, except where separate agreement is required by law.

18. Governing law and disputes

19. Miscellaneous

These Terms, together with the [Privacy Policy] and the AUP, are the entire agreement between you and EnKrist regarding the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. We may assign these Terms (e.g., in a corporate transaction); you may not assign them without our consent.
